These Terms of Service ("Terms") govern your use of Evolvify Hosting services. By creating an account or using our services, you agree to these Terms.

1. SERVICES OVERVIEW

Evolvify Hosting provides game server hosting services, including:

• Minecraft server hosting (vanilla, modded, SMPs, modpacks)
• Community and multiplayer server hosting
• Future and upcoming support for Hytale and similar games

Services may be modified, expanded, or discontinued at any time.

2. ACCOUNT REGISTRATION AND SECURITY

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials and all activities performed under your account.

3. GAME-SPECIFIC TERMS (MINECRAFT AND HYTALE)

• You must comply with all applicable game publisher EULAs, including Mojang Studios' Minecraft EULA and any future Hytale EULA.
• Hosting pirated, cracked, or unauthorised game servers is strictly prohibited.
• You are responsible for all content hosted on your servers, including mods, plugins, datapacks, scripts, and user-generated content.
• Evolvify Hosting does not actively monitor in-game content unless required by law or abuse reports.

4. ACCEPTABLE USE POLICY

You may not use our services to:

• Host malware, exploits, or malicious software
• Conduct hacking, DDoS attacks, or network abuse
• Circumvent service limits or security measures
• Violate copyright or intellectual property laws
• Operate illegal services

5. PAYMENTS, BILLING, REFUNDS, AND CHARGEBACKS

• Services are billed in advance unless stated otherwise
• Failure to pay may result in suspension or termination
• Refunds are provided at Evolvify Hosting's discretion unless required by law
• Chargebacks or payment disputes may result in immediate termination

6. SERVICE AVAILABILITY AND SLA

Services are provided on an "as-is" and "as-available" basis. Evolvify Hosting does not guarantee uninterrupted service or specific uptime levels.

7. BACKUPS AND DATA RESPONSIBILITY

Customers are responsible for maintaining backups unless backup services are explicitly included. Evolvify Hosting is not liable for data loss.

8. SUSPENSION AND TERMINATION

We reserve the right to suspend or terminate services without notice for violations of these Terms, abuse, non-payment, security risks, or legal requirements.

9. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Evolvify Hosting is not liable for indirect, incidental, or consequential damages arising from service use.

10. INDEMNIFICATION

You agree to indemnify and hold harmless Evolvify Hosting from any claims, damages, or liabilities arising from your use of services or violation of these Terms.

11. DMCA AND COPYRIGHT COMPLAINTS

Evolvify Hosting complies with applicable copyright laws, including the Digital Millennium Copyright Act (DMCA). Valid takedown requests may result in content removal or service suspension.

12. LAW ENFORCEMENT AND ABUSE REPORTS

We may cooperate with lawful requests from authorities and investigate abuse reports at our discretion.

13. GOVERNING LAW AND JURISDICTION

• Australian customers: governed by Australian law
• United States customers: governed by applicable US federal and state law
• United Kingdom customers: governed by the laws of England and Wales
• Canadian customers: governed by the laws of the applicable province

14. CHANGES TO THESE TERMS

We may update these Terms at any time. Continued use of services constitutes acceptance of updated Terms.
